FOR YOUR INFORMATION:
The State Board of Education approved the Part B State Plan for Special Education at the November 27, 2012, meeting. Prior to the State Board action, the Office of Special Education published the proposed Part B State Regulations changes, solicited public comments, and held two public hearings via webinar.
The Part B State Plan regulations do not go into effect until they have been submitted to the Secretary of State, approved by the Administrative Rules Division and Joint Committee on Administrative Rules, and published in the Missouri Register for a period of 30 days. A SELS message will be sent notifying you when the regulations become final.
The proposed regulations, as approved by the State Board of Education, can be found on our website at http://dese.mo.gov/se/stateplan/index.html. Until the regulations become final, responsible public agencies should follow the provisions of federal statute and regulations (IDEA 2004), state statutes and the Missouri State Plan for Special Education-2010. If you have questions regarding the proposed regulations or provisions of the state and federal statutes and regulations implementing the IDEA that your agency should be implementing, you may contact the Compliance Section of the Office of Special Education at 573-751-0699 or email@example.com.
