TIMELINE FOR HEARING PANEL’S DECISION
The request for due process was made by representative on June 18, 1999. The hearing panel was empowered on June 29, 1999, with Janet Davis Baker serving as Chairperson and Betty Chong and Ed Mills appointed as hearing panel members. The initial deadline for the issuance of the hearing panel’s decision was August 2, 1999, which is 45 days from the date the Missouri Department of Elementary and Secondary Education received the request for due process. On July 9, 1999, the representative for the South Iron County R-I School District requested an extension of time for the hearing panel’s decision to October 29, 1999. This request was granted by the Chairperson. Subsequently Ed Mills withdrew as hearing panel member and Beth Mollenkamp was chosen to replace him. The school district’s representative made another request to extend the time for the hearing panel’s decision up to and including December 6, 1999, which request was granted by the Chairperson. Because the parties agreed that the hearing on this matter be scheduled for the week of December 6, 1999, an additional extension of time for the hearing panel’s decision was requested by the representative for the school district, to a date 30 days after December 10, 1999. This request was granted by the Chairperson with a decision due January 9, 2000.
DECISION
The hearing was conducted the week of December 6, 1999, at the South Iron County R-I School District’s elementary school. On the morning of December 10, 1999, the parties advised the Chairperson that a settlement had been reached. Pursuant to the settlement, the parties requested that the hearing panel dismiss with prejudice the pending matter before it. Accordingly, the hearing panel dismissed the above-captioned matter with prejudice.
