Missouri's "Procedural Safeguards for Parents and Children" Statement for
Part B of the Individuals with Disabilities Education Act (IDEA) has been
revised. We have adopted the model developed by the U. S. Department of Education, Office of Special Education Programs and inserted
Missouri specific information. This model incorporates all changes required
by the final federal regulations implementing IDEA 2004. The date on this
copy is October 2006. This document can be accessed on the division website
at
http://dese.mo.gov/divspeced/Compliance/Proc_Safe/index.html.
Agencies should discard any copies of the old Procedural Safeguards
Statement (July 2005) and begin using this new copy immediately by
downloading. In the near future, the Division will be providing each
responsible public agency with copies of the new Procedural Safeguards
equivalent to the number of students reported on the agency's December
1, 2005, child count. When these are received, the agency must
distribute these copies to each parent of a child with a disability in
their district, who has not already been provided the new version. The
Procedural Safeguards document is to be provided to the parent:
* once each school year
* upon initial referral for evaluation
* on the date the decision is made to make a removal that constitutes a
disciplinary change of placement due to a violation of the code of
student conduct
* upon parental request for an additional copy
* upon the first occurrence of the filing of a due process hearing
request or child complaint in a school year, at which time the
Department of Elementary and Secondary Education (DESE) provides the
procedural safeguards statement
DESE is in the process of developing copies of the new Procedural
Safeguards in foreign languages most commonly used in Missouri as well
as a video production of an American Sign Language interpretation. When
these are available, a SELS message will be sent. Braille and Large
Print may be requested by agencies at any time.
Watch for announcements of future compliance regional training sessions
that will address key compliance issues, including some of the major
changes required by the final regulations for IDEA 2004. |
