FOR YOUR INFORMATION
Public agencies in the state are required to offer and/or provide special education and related services to students with disabilities who are incarcerated in local county or city jails (NOT in the Department of Corrections) or are in Juvenile Detention Centers within the agency's boundaries. The Office of Special Education has developed some guidance documents to assist agencies in determining their responsibilities to these students.
A Question and Answer document has been posted concerning Incarcerated Youth (youth detained in local county or city jails-NOT in the Department of Corrections) at: http://dese.mo.gov/divspeced/Compliance/Q&A/IncarceratedYouth.html.
Two guidance documents are provided for agencies serving youth in Juvenile Detention Centers. These are posted at:
http://dese.mo.gov/divspeced/Compliance/JuvenileJustice-SpecEd.html.
If you have specific questions not addressed in either of these documents, please contact the Special Education Compliance Section at 573-751-0699 or secompliance@dese.mo.gov.
