Subject: Implementation Timelines for Revised
Part B State Regulations

This message is being sent to respond to questions we have received about
the implementation date for the revised Part B State Regulations
implementing the Individuals with Disabilities Education Act (IDEA).
At the April 2007 meeting, the State Board of Education approved a proposed
change for the Part B State Regulations implementing IDEA. The final
regulation can be found on our website
http://dese.mo.gov/divspeced/stateplan/index.html. The regulation has
been submitted to the Office of the Secretary of State for publication in
the Missouri Register. The regulation will be final thirty days after
publication, which we hope will be in June.
Once we know the publication date, notification will be sent via SELS of the
implementation date of the regulation.
Prior to the effective date of the regulation, Responsible Public Agencies
should follow the provisions of IDEA 2004, which took effect July 1, 2005,
and the federal regulations implementing IDEA 2004 which took effect October
13, 2006, and the current state plan to the extent
it is consistent with IDEA 2004 and the federal regulations.
