1. Nonpublic Reports Available for LEA
It is the public school district’s responsibility to review for accuracy the information submitted on the Nonpublic Registration Forms. This information will be used to determine allocations for nonpublic services for the 2011-2012 school year. If you feel the information is not accurate, consult with the nonpublic schools. If errors are found, the nonpublic schools may make changes to their registration form through the end of March. No changes will be accepted after March 31, 2011.
No Child Left Behind requires timely and meaningful consultation between public school district personnel and representatives of private schools. Through consultation, it is the public school district’s responsibility to assist the private schools with the Nonpublic Registration Forms. If the private school chooses not to participate, it is imperative that the public school district document their effort regarding contact with the private school.

Nonpublicindex.html. For Title I purposes, review the information on the Nonpublic Title I Report to determine which nonpublic schools have students residing within your school district. For the rest of the federal programs, review the enrollment information on the Nonpublic Information Report.

3. Evaluation of Nonpublic Services
An LEA must annually assess the progress of the Title I program toward enabling private school Title I participants to meet the agreed-upon standards. During the consultation, public and non-public officials should determine ways to assess the improvement in student outcomes that should be expected as a result of the provision of Title I services. This is not restricted to standardized achievement tests. Tests in reading fluency, comprehension, numeracy, etc. can be used for Title I students. An agreement must be made relative to the amount of progress that is to be expected. At the end of the year, a discussion should take place relative to the actual progress and what needs to happen to improve even more in subsequent years. It is appropriate to consult with the non-public teachers of Title I students to better understand the progress they are making in their regular classroom.
If the expected annual progress is not met, the LEA, after consultation, must review its program and determine modifications it should make in order to improve the effectiveness of the Title I program in raising the achievement of private school participants. The district must keep documentation of this evaluation process.

4. Title I Professional Development
Section 200.66 of the Title I regulations states that an LEA must use Title I funds to meet the special educational needs of participating private school children, and the LEA may not use Title I funds to meet the needs of the private school or the general needs of children in the private school. Only private school teachers of Title I participants may receive professional development activities paid with Title I funds. Private school teachers who do not have Title I participants may not attend professional development activities paid with Title I funds.
The professional development activities offered to private school teachers should reflect not only the needs of the children being served by the Title I program but also the skills and knowledge that private school teachers need in the classroom to better instruct the Title I children. After the first year of a program, the student assessment results also should determine the content of the next professional development program for private school teachers of Title I students.
5. Statement of Nonpublic School Consultation and Participation Forms
The public school is required to consult with nonpublic schools before decisions are made that could affect nonpublic services. This consultation must be timely and meaningful. The consultation must include discussions of what services will be provided, when and where the services will be provided, and how and by whom the services will be provided. The Public/Private Design for Education Service form should be used to document this discussion.
After consultation with the nonpublic schools, districts are required to submit the Statement of Nonpublic School Consultation and Participation forms to DESE. These forms are required before the consolidated application can be accepted. The Nonpublic Reports mentioned in item three above will help you determine which nonpublic schools should be included in the consultation process. For public school districts that are on the Title I bypass program, you are not required to submit consultation forms for the Title I program.

6. Complaint Procedures for Nonpublic Schools
The public school district must distribute a copy of the Complaint Procedures for Nonpublic Schools to the nonpublic schools during consultation.
